SUPREME ATLANTA
Advertising Contract Agreement

I, (enter full legal name)(hereinafter known as Entertainer) hereby agree with SUPREME ATLANTA (hereinafter known as SUPREME) as follows:

I understand that SUPREME will provide me the media advertising for relaxation therapy, adult entertainment, or any other service that I may legally deliver.

I agree that I am of legal age and of sound mental capacity to enter into a legally binding contract, and SUPREME agrees to protect and not disclose, except under court order, my personal identity to anyone with this confidentiality clause.

I am not an employee of SUPREME, and I am not entitled to any employee benefits or programs including but not limited to vacation, medical, retirement, worker’s compensation, or any other fringe benefit. I am also not subject to the provisions of any personnel policy or rules and regulations applicable to employees of SUPREME, and I shall fulfill my obligations independent of any supervisory control by SUPREME.

I shall be solely responsible for reporting and paying all taxes, social security, etc. on any income earned by me as a result of the advertising venues of SUPREME.

I agree to pay $200.00 per week, as a media advertising fee, to SUPREME. This fee is due in full regardless of how many days in the week that I advertise. Fees are subject to change, but SUPREME will inform me well in advance of doing so. I also agree to pay any additional fees, including late fees and service charges, that may be incurred. Currently, the late fee is an additional $25.00 when the full fee is not paid prior to the begining of the advertising week

I understand that SUPREME does not make any promises or guarantees as to the amount of calls I receive, or the amount of money I make. I am an independent contactor therefore, all clients will contact me directly, I will set my own appointments, and I collect my own money, completely independent of SUPREME. Furthermore, I will pre-pay my weekly advertising fees, and I understand I am due no refunds.

I have the option of supplying my personal photograph or photographs (no stock photography is allowed) to SUPREME. I grant SUPREME unconditional approval to publish my photographs or likenesses in any and all forms of media. Furthermore, the images and likenesses become the sole property of SUPREME. I attest to the following:
(a) ENTERTAINER is the sole and exclusive owner of (or controls) all rights in and to the Pictures which Pictures are wholly original and have not been copied in whole or in part from any other work, picture or source; the Pictures are neither fake nor "stock" photography;
(b) The person(s) recorded in the Pictures was over the age of eighteen (18) years at the time the Pictures were recorded;
(c) No claim has been made against ENTERTAINER and that ENTERTAINER knows of no claim that the Pictures infringe the copyrights or violate the rights in any other work and/or of any person, film, or corporation whatsoever. The Pictures are not in the public domain and enjoy and will enjoy, either statutory or (to the extent it may exist) common law copyright protection in the United States and all countries adhering to the Berne and Universal Copyright Conventions;
(d) All obligations with respect to the Pictures, including but not limited to, all salaries, royalties, present and future license fees, service charges and the like, have heretofore been fully paid. The Pictures contain no libelous material and do not violate any laws in effect as of the date of this Agreement; and
(e) ENTERTAINER shall defend, indemnify and hold harmless SUPREME, its successors and assigns, officers and directors, from and against any losses, damages, costs, charges, reasonable attorney's fees, recoveries, actions, judgments, penalties, expenses and other losses whatsoever which may be obtained against, imposed upon or suffered by SUPREME, its successors, assigns, officers and directors, by reason of the breach of any warranty, covenant, agreement or a misrepresentation made by ENTERTAINER hereunder.
I understand that SUPREME’S advertising may provide: a) Verbal and/or written descriptions of my appearance. b) Representations of my photographs and likenesses. c) The area of town that my business is located in. d) A direct phone number to me. e) A link to my website, if I have one, and I will also provide a reciprocal link to the SUPREME website. f) An e-mail address if desired. SUPREME retains final approval of all ads.

I agree not to engage in any illegal activities with any client referrals I receive from the SUPREME advertising methods, and I understand that if I’m convicted of such dealings that I will no longer be welcome as an advertiser with SUPREME.

It is my sole responsibility to obtain any and all required licenses and/or certifications for business and/or activities conducted by me. SUPREME does not validate this information, as it is understood that I have followed proper procedure.

I agree that at no time during my association with SUPREME, or for a period of two (2) years immediately following the last date of conducted business between myself and SUPREME, will I engage in the same or similar business (marketing and advertising to promote adult entertainers and masseuses) engaged in by SUPREME within the boundaries of the state of Georgia, nor will I directly or indirectly for myself, or on behalf of or in conjunction with any other person, partnership, corporation, or company, solicit or attempt to solicit the business or patronage of any person, corporation, company, or partnership within said territory for the purpose of engaging in the same or similar business as SUPREME. ~This is a NO COMPETE clause.~

I agree that for any violation of the “no compete clause,” a restraining order and/or an injunction may be issued against me in addition to any other rights SUPREME may have, including the right to recover actual monetary damages and collection costs associated therewith, including court costs, reasonable attorney’s fees, and treble damages as provided for in the (Unfair Trade Practice Act) codes for the state of Georgia.

This agreement shall be binding upon, and be to the benefit of both parties, their successors, assigns, and personal representatives, forever.
